Local Searches – Havering
We have a direct electronic link with the local authority to order searches. The London Borough of Havering are very helpful and responsive to search requests. Typically we would expect the search result back in around 1 week. Some lawyers / solicitors / conveyancers quote longer – 2 weeks because they rely on their search provider to source the search rather than going direct or worse still use personal searches not official* local authority searches which take longer than the real thing . The direct link also keeps the search cost down – currently the fee is £85.00 which we believe if very competitive especially for a London Borough.
All this means that you have a quick turn around on the paperwork which is useful if you have a four week deadline to exchange contracts.

Local Knowledge – Restrictive Covenant Issues
Local knowledge helps the transaction. We deal with a lot of transactions on Emerson Park – this has it’s own planning policy and quite often plans to develop or extend are caught by restrictive covenants which were imposed some time ago. This is an area where developers and self-build owner/occupiers often purchase – quite often buying a large plot with a small house or bungalow to knock down and rebuild. In this area we often look to indemnity insurance to insure out of the risk of consent – this can be obtain pre build as well as after the works have been completed.
Much of Hornchurch is subject to restrictive covenants of one type or another. Elm Park for example is subject to restrictions imposed by a major developer in the area (at the time) namely the Costain group. If you follow the letter of the restrictions on the title any external change to the property (for example an extension or conservatory) would need prior written consent from Richard Costain Limited. Plans would need to be sent to them for stamping. But local knowldge tells us that this company decided in the 1970s not to pursue any consents and therefore the need to go through this procedure is no longer required. We have a letter from the developer dating from the time confirming this and as such it means that you would not, as a seller be required to pay for indemnity insurance on your sale or as a buyer insist on it for your purchase.
Leasehold Flats – extra costs to look out for
We provide many buyers with assistance in relation to leasehold purchases. The leases in Hornchurch range from ex-local authority lease (look out for the 2 year planned “major works” charges which often pop up at the last minute on enquiries) to converted flats and purpose built blocks.
